Major Retailer Sued for Alleged Disability Discrimination
Employees contribute to the success of the companies they work for on a daily basis. In exchange for the work they perform, they have the legal right to fair treatment in the workplace, especially if they face a physical challenge such as a disability. Unfortunately, there are several instances where workers face discrimination.
One Texas employee claims he was discriminated against due to a disability. The man recently filed a lawsuit against a large retail chain claiming he was the victim of retaliation and discrimination due to disability, race and color.
Discrimination and Harassment
According to the plaintiff, he suffers from dyslexia, autism and has impaired mobility due to rods placed in his back, though none of this interfered with his job performance. According to the lawsuit, five years ago, the man’s coworkers and supervisor began subjecting him to harassment and abuse.
He also alleges that the discriminatory conduct became worse after he reported the situation to the company’s human resources department.
Damages Sought Due to Loss of Benefits and Income
According to the lawsuit, the employee’s hours were cut from full-time (35-40 hours a week) to part-time (five hours a week). He believes this was due to a complaint about the unfair treatment from his supervisor and coworkers which was filed in 2011.
The cut in hours caused the employee to lose benefits and income, which is why he is seeking damages that include reinstatement of pay as well as compensatory, punitive damages and attorney fees.
